Cal. Civil Code §1748 refers to a specific section of the California Civil Code that pertains to the prohibition of surcharges on credit card transactions. This section is commonly known as the "California Credit Card Surcharge Ban."


Under Cal. Civil Code §1748, merchants in California are generally prohibited from imposing surcharges or fees on customers who choose to pay with a credit card. However, they are allowed to offer discounts or other incentives for customers who pay in cash or by other means.  * The Cash Discount program offers customers an incentive to pay with cash.
